Danish national man receives deferred sentence for distributing nude film clips on the social platform Reddit
A Danish citizen has been convicted of uploading sexually explicit segments from protected films and television shows on the online platform Reddit.
Based on a police document reviewed by media outlets, the unnamed man shared 347 video excerpts of explicit scenes in a subreddit he managed, which were then viewed 4.2 million times.
Danish police confirm he has been given a 7-month suspended jail term for copyright infringement.
Experts explain the defendant was prosecuted under a seldom-invoked clause in Danish copyright law, with the court finding that by removing the footage out of their intended setting, the man had damaged the artists' "ethical entitlements".
He has additionally been convicted of sharing more than 25 TB of copyrighted data.
From March 2022 to May 2023, the user known as "KlammereFyr" on Reddit posted sexually explicit clips including over 100 female performers.
He shared them in the forum he was a moderator of.
Per the Denmark's anti-piracy organization the Rights Alliance, his online community had more than 6,000 subscribers and participants were encouraged to request clips of particular actors.
In last year, advocates reported the case to the police on behalf of the impacted actors, filmmakers and producers, which led to the subreddit being closed down.
Andrea Vagn Jensen, one of the performers whose nude content were circulated in the community, explained to Danish broadcasters at the time she felt there was a difference between appearing unclothed in a film and appearing on Reddit.
The performer stated the posts amounted to "exploitation".
'A significant signal'
The man was arrested in September 2024 and admitted culpable to the charges last month.
In a comment after the ruling, the head of the Rights Alliance Maria Fredenslund remarked the outcome sent an "important" message "indicating infringements of artists' rights has consequences".
The ruling is viewed as unprecedented in the country for its use of the "moral rights" clause of the Danish Copyright Act, which states an creator's creation cannot be used in a manner which violates their standing.
Intellectual property specialist a legal scholar told BBC News the legal matter was "unusual" for its focus on the damage to the dignity of an performer, rather than to them financially.
The extent to which the case could influence other countries is unclear.
But she said there may be "more and more of these actions" in the coming years with the growth of AI, where "the integrity of an individual's creative output might be compromised with greater ease".
