New Jersey's top prosecutor leaves her post following appeals court rules against her service.
Alina Habba has resigned as the chief federal prosecutor in the state. This follows a judicial decision that questioned her eligibility to occupy the role.
Attorney General's Statement
US Attorney General, Pam Bondi, announced Habba's resignation on the start of the week. In a statement that the appeals court finding made it unworkable for her to lead the department effectively.
"Do not interpret adherence to the ruling as defeat," she declared. "The effort will now reach across the country."

Her resignation comes a week after a US appeals court determined that she had been unlawfully serving as the top prosecutor. This ruling is could influence many prosecutions in the state.
The court said that a temporary posting that did not receive the advice and consent of the Senate breached the statute on vacant positions.

It was also stated that the former prosecutor will continue working within the DOJ as a high-level advisor. Habba plans to pursue additional appeals of the disqualification, aiming for a reversal.
In a statement, Bondi contended that the judiciary "must not second-guess the President's choice of prosecutors tasked with executing the fundamental role of the presidency of criminal prosecution."

Bondi commended her tenure and noted that under her leadership, the city of Newark saw a significant drop in offenses. It was also reported that the city of Camden experienced its first summer in half a century with no murders.

Habba, 41, originally became part of Trump's personal legal team in recent years. Subsequently, she acted for Trump in his hush-money trial in New York last year, when he was guilty verdict on dozens of charges of financial record manipulation.
